Objectives:
This article provides an overview of regulations related to the process of combating illegal and harmful content, in force in selected European Union countries. Coordination in defining illegal content and digital content in the context of cross-border digital services is becoming particularly important following the entry into force of the Digital Services Act

Material and methods:
Comparative method - EU countries: Germany, France, Poland

Results:
Differences in the understanding of the definition of illegal content may negatively impact the coordination of combating it, not only at the level of relations between the EU and platforms and social media (BIG TECHY) but also at the level of EU Member States.

Conclusions:
Taking into account the cross-border nature of digital services and combating illegal or harmful content in these services becomes problematic given the fundamental differences in the definitional approaches in the various legislations of EU Member States, not just in the regulatory framework of relations between the EU and BIG TECHY. These differences may pose a fundamental challenge to building a unified and secure digital services market.
