ABSTRACT
This paper examines whether European Union environmental policy can be subsumed under the protective scope of Article 37 of the EU Charter of Fundamental Rights, which mandates a high level of environmental protection and improvement of environmental quality. Building on doctrinal legal analysis, the paper evaluates the development, objectives, and principles of EU environmental policy as laid down in Articles 11 and 191–192 TFEU, accompanied by relevant case law of the Court of Justice of the European Union, particularly the judgment in Janecek v Freistaat Bayern (C‑237/07). The analysis demonstrates that EU environmental policy is structured around binding goals, guiding principles such as precaution, prevention, source control, and the polluter‑pays principle, as well as detailed procedural requirements that ensure a consistently high level of protection. Although Article 37 EU‑GRC does not establish an individually enforceable subjective right, the results indicate that the substantive orientation and legislative output of EU environmental policy clearly correspond to its normative content. The discussion highlights that the primary weakness lies not in the Union’s regulatory framework, which is among the strictest globally, but in the inconsistent and insufficient implementation of EU environmental law by Member States. Effective enforcement and coordinated application therefore remain decisive for realizing the protective mandate of Article 37 EU‑GRC in practice.
